Terms & Conditions

By making any form of purchase or agreeing with JWP Computer Services Ltd to carry out services on your behalf, you confirm that you are in agreement with JWP Computer Services Ltd and bound by the terms and conditions below.

Definitions:

The Client: The company or individual requesting the services of JWP Computer Services Ltd.

JWP Computer Services Ltd: The JWP Computer Services Ltd website, shop, owner, employees and affiliates, hereafter referred to as JWP.

General

JWP will carry out work only where an agreement is entered either by email, telephone, mail or fax.

JWP will carry out work only for clients who are 18 years of age or above.

An 'order' is deemed to be a written or a verbal contract between JWP and the client; this includes telephone and email agreements.
 
1. Website Data

The description and price of the goods you order will be a reflection of any suppliers’ website at the time you place your order.

Our best efforts are made to ensure the prices, images and descriptions on all of our online products are 100% accurate at the time of purchase. JWP cannot be held responsible for any inaccurate descriptions provided by our suppliers.

If JWP are found to be responsible for the sale of any goods on our website which do not meet the description JWP will suspend the sale of any incorrect product until a correct description is available. If you have received any goods as incorrectly described, please contact us on 01332 730999 or email support@jwpcomputerservices.com where we will happily facilitate the collection of your goods and arrange a replacement or refund where applicable. This does not affect your statutory rights.

2. Free Services

Free PC Health Checks are subject to computer and laptops that display a POST (Power On Self Test) screen, meaning there are visual signs that the computer will turn on and begin to boot, therefore a problem exists after this point.

Free local collection and delivery service is available within a 5 mile radius of our Derby workshop. This service is subject to a minimum workshop charge.
 
3. Trade goods

All goods are subject to availability.

If we are unable to complete your purchase request due to stock or demand, we will refund you for any sum that you have paid and any contract relating to that purchase will be cancelled.

Every effort is made to ensure that prices shown on our websites are accurate at the time your order is placed. If an error is found within 14 days of accepting your order, JWP will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order.

If JWP does not receive an order confirmation within 14 days of informing of an error, your order will be cancelled automatically. If you cancel the order, or if the order is cancelled automatically due to the expiry, JWP will refund you for any sum that you have paid and any contract relating to that purchase will be cancelled.

Limitations of liability:

JWP shall not be liable for any loss or damage in circumstances where:

- there is no breach of a legal duty owed to you by JWP, its employees or agents;

- such loss or damage is not a reasonably foreseeable result of any such breach;

- any increase in loss or damage resulting from breach by you of any term of this contract.

Nothing in these conditions excludes or limits the liability of JWP for death or personal injury caused by negligence or fraudulent misrepresentation.

If you are a business customer, JWP shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.

4. Hardware

Applications, drivers, BIOS/firmware and games are often released to market with bugs that can affect hardware performance. As a result JWP cannot guarantee that every hardware product is 100% compatible with every software product available.

5. Software

All computers sold are covered by a hardware warranty that covers all labour costs relating to replacement/repair of hardware that is found to have developed a fault whilst being within its warranty period. Software is not covered by this warranty.

If you have purchased a JWP computer your software has been tested for compatibility with your hardware, many influences can affect the operation of computer software and it is your responsibility, as a customer, to maintain the correct operation of this software after the date of purchase. If a JWP computer is returned with a suspected fault and a diagnosis of software corruption is made then we may offer additional repair service at agreed costs.

Retail software

In the unlikely event that you suspect that you have purchased faulty software from JWP Computer Services Ltd you need to contact the manufacturer to obtain confirmation of a fault before approaching ourselves to exchange the software, we cannot offer a cash refund except on software returned unopened within the first 28 days from purchase.

6. Delivery

All orders will be shipped to the billing address only, this is to limit fraudulent transactions. Please ensure the details you enter are correct before submitting a purchase as we cannot be held responsible for any incorrect data entered by the consumer. Please note, addresses outside of mainland UK will not be covered.

Upon arrival of the goods you will be required to check the condition of the goods before signing.

Our goods are generally subject to delivery charges, these charges are identified at the point of purchase or within the goods description.

JWP recommend the "Recorded (signed for)" delivery option when purchasing goods from our website, however, it is solely your decision as to which delivery option you choose.

Recorded (signed for) will include delivery insurance when in transit and should arrive within 1-2 working days, JWP cannot be held responsible for any delays by the courier used and so do not guarantee delivery times.

Standard Delivery does not include insurance but the parcel will be suitably wrapped before shipping, this method is normally recommended for small goods such as memory, cables and ink cartridges, JWP cannot be held responsible for any delays by the courier and so do not guarantee delivery times.

We do offer a collection service for online purchases; please visit our store for local purchases and collection details.
 
Your order will only be dispatched when a successful payment has been received.
 
7. Warranty

All NEW goods supplied by JWP are warranted free from defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.

This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by JWP, failure to follow instructions, or any alteration or repair carried out without the approval of JWP.

If the goods supplied to you are damaged on delivery, you should notify JWP by telephone, in writing or by emailing support@jwpcomputerservices.com within 14 days.

If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify JWP by telephone, in writing or by emailing support@jwpcomputerservices.com, as soon as possible, but in any event within 14 days of the date you discovered or ought to have discovered the damage, defect or complaint.

In addition to your statutory rights, we are happy to provide free technical support to all JWP Computer Services Ltd customers who require help or advice regarding products purchased from JWP Computer Services Ltd within 28 days of the original purchase date. To obtain technical support please call us on 01332 730999 or email support@jwpcomputerservices.com.

All Technical Support and Returns requests are usually handled directly by the manufacturer or their appointed agent. This is often the best solution for the customer with the highest standards of technical support, latest information and fastest returns processing. For manufacturer returns details please see your product documentation or contact us for assistance in locating this information.

Exceptions:

2nd user (second hand) parts have a 30 day warranty.

We are always here to help you. For Manufacturer's who do not provide a direct service JWP Computer Services Ltd will provide Technical Support and Returns service for up to 1 year from date of purchase. 8. Returns

Please take reasonable care to ensure returned goods are actually defective and the problem experienced is not caused by another component in your system or by software configuration. If after having received Technical Support information you are completely satisfied you have faulty goods you must request an RMA number (Return Merchandise Authorization) from our technical team.

If a hardware defect is confirmed we will provide a suitable remedy dependable upon the circumstances. If after our examination we dispute the failure we will contact you to discuss the suspected fault further.

With the exception of the confirmed defect itself, the condition of the goods will relate to the remedy we are willing to offer, it is often useful if you do keep packaging and accessories.

9. Modified Goods

Any goods that have been modified or physically altered in any way may be excluded from the warranty we are able to offer. If unsure please contact us before you attempt a modification / upgrade for further clarification.

10. Packaging

Returned items must be packaged properly. It is your responsibility to ensure returned goods are fully insured and properly packaged. JWP cannot take responsibility for goods that are damaged or lost whilst being returned, even if faulty.

11. Testing

All returned items are tested by JWP technicians. It is essential that goods are tested as approximately 50% of all received returns are tested not faulty. It is therefore important that you include a detailed description of the problems experienced. Any item found to be not faulty will be subject to a £15.00 retest fee.

12. Website Design

If continued delays are caused by the client for completion of a project or collection of property which exceeds a reasonable amount of time, JWP reserves the right to charge a holding, handling or development fee where cost or administration is required as a direct result of the delay.

JWP endeavour to respond to all requests within 48 hours and make any requested changes within 5-10 working days, JWP are not responsible for any delays caused by the client.

Whilst every endeavour will be made to ensure that the website and any scripts or programs are free of errors, JWP cannot accept liability for any losses incurred due to malfunction, the website or any part of it.

The website, graphics and any programming code remain the property of JWP until all outstanding accounts are paid in full.

Any scripts, cgi applications, databases, or software (unless specifically agreed) written by JWP remain the copyright of JWP and may only be commercially reproduced or resold with the permission of JWP.

JWP cannot take responsibility for any copyright infringements caused by materials submitted by the client. JWP reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

Any additions to the brief will be carried out at the discretion of JWP and where no charge is made by JWP for such additions, JWP accept no responsibility to ensure such additions are error free and reserve the right to charge an according amount for any correction to these or further additions.

Services, features, scripts or solutions provided by a third party may be used with approval of or at the request of the client.  JWP are not responsible for or liable for any problems that these solutions may cause and they are not supported or guaranteed by JWP.

The client agrees to make available as soon as is reasonably possible to JWP all materials required completion the site to the agreed standard and within the set deadline, JWP cannot be held responsible by any delays caused by the client.

JWP will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

JWP will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner.

JWP will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents.

JWP will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

All websites will be completed as per the agreement between JWP and the Client, any additional changes; revisions or ongoing services provided by JWP will be charged at an additional fee in accordance with our payment terms, we will always notify you where any additional costs are incurred.

Once a website has been designed and completed any final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e. If the client decides they no longer want the site, as they have commissioned the work and have already paid or if the client decides to change the project after work has been carried out they are still obliged to pay for the work that has been done. Non payment will result in legal action being taken if necessary.

At the time of completion all websites are designed to be compliant with W3C Web standards.  All coding used (CSS, HTML, DHTML, PHP and JavaScript) is tested in their environment to be compatible with web standards and the default end user screen resolution (1024 x 768 pixels) as well as the most commonly used browsers, Internet Explorer 6, Internet Explorer 7, Mozilla Firefox and Opera browsers, however, JWP does not guarantee websites will be browser compatible in test, currently un-released or yet to be developed browsers.

13. Database, Application and E-Commerce Development

JWP cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.

Where applications or sites are developed on servers not recommended by JWP, the client is expected to provide or seek any information, additional software, support or co-operation pertaining to the server required in order for the application to be correctly developed. Where large applications are to be developed, it is the client’s responsibility to provide a suitable testing environment which is identical to the final production environment.

The client is expected to test fully any application or programming relating to a site developed by JWP before being made generally available for use. Where "bugs", errors or other issues are found after the site is live, JWP will endeavour (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief.

14. Website Hosting

Whilst JWP provides high end hosting for you website, no guarantees can be made as to the availability or interruption of this service, therefore JWP cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

JWP reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate any service and share information with law enforcement agencies should the necessity arise.

15. Content

All services provided by JWP may only be used for lawful purposes. The laws of the United Kingdom apply.

The customer agrees to indemnify and hold harmless JWP from any claims resulting from the use of our services.

Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted material. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. If you believe that your copyright or trademark is being infringed upon, please email support@jwpcomputerservices.com with the information required. If the request is of a licensing issue, we may require further documentation.

Any attempt to collect personal payment details from your website visitors or otherwise collect, share or distribute confidential or illegal information insecurely or against any UK laws will be deemed as misconduct and will directly result in the immediate termination of your account.

Any illegal use of our websites, hosting or domains will result in the immediate termination of your account, in addition we reserve the right to share your personal details to any law enforcement agency where any laws are broken or any investigation is required due to misconduct.

Examples of unacceptable material include:

IRC Bots, Proxy Scripts / Anonymisers, Pirated Software / Warez, ".img" / image hosting only sites that do not host an actual domain name, Escrow, High-Yield Interest Programs(HYIP), Bank Debentures, Bank Debenture Trading Programs, and Prime Banks Programs, lottery sites, muds / rpg's, hate sites, hacker focused sites/archives/programs, sites promoting illegal activities.

We reserve the right to refuse service to anyone. Any material that in our judgment that is obscene or threatening is prohibited and will be removed from our servers with or without notice.

Failure to respond to email from our abuse department within 48 hours may result in the suspension or termination of your services.

If in doubt regarding the acceptability of your site or service please contact us and we will be happy to assist you.

Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography.

Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.

JWP reserve the right to suspend your account if there is suspicion or reports of misconduct or illegal use, you will be notified while an investigation is carried out. Violations will be reported to the appropriate law enforcement agency.

16. Zero Tolerance Spam Policy

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups.

JWP reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.

JWP reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is entirely at the discretion of JWP.

17. Email Usage

There are pop email limit per domain. If you send over this amount in any hour most of the e-mails will bounce back with an undeliverable error, your email account may be temporarily suspended, an investigation will then take place.

Spamming, illegal content or request, harassment or any other form of misconduct with our mailservers will result in the termination of your mail server and email accounts while an investigation is carried out.

Any mailing list larger than 5,000 will require a semi dedicated or dedicated hosting solution from us. Note: dividing one large list into smaller lists to get below this limit is not allowed.

18. Compatibility

JWP will endeavour to ensure that any developed/designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer Version 6 and 7 and to an acceptable level with Mozilla Firefox and Opera browsers. JWP can offer no guarantees of correct function with all browser software.

JWP endeavour to create all website compliant to W3C Web standards (http://validator.w3.org/), All coding used (CSS, HTML, DHTML, PHP and JavaScripts are tested in their environment to be compatible with web standards and the default end user screen resolution (1024 x 768 pixels) as well as the most commonly used browsers, Internet Explorer 6, Internet Explorer 7, Mozilla Firefox and Opera browsers, however, JWP does not guarantee that all websites will be browser compatible outside an Microsoft Internet Explorer environment.

19. Cancellation

You have the right to cancel any service contract within 10 days of purchase, this must be done in writing or by emailing support@jwpcomputerservices.com.

Please note that telephone cancellation is not a sufficient method of cancelling this contract.

If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to JWP at your own cost. You must take reasonable care to ensure the goods are not damaged in the meantime or when in transit.

If you exercise your right of cancellation after a service has been provided, including but not limited to web hosting, domains, web developers cost and workshop repairs, you will be refunded less the amount equal to the cost of work and services provided up until the time of cancellation.

In the event the goods are returned damaged or faulty JWP reserves the right to charge you a sum not exceeding the cost of the goods.

You do not have the right to cancel the contract if the order is for computer software which has been unsealed by you, or for consumable goods which, by their nature, cannot be returned, save where a fault is discovered which could not have been discovered otherwise than by unsealing the goods.

20. Payment of Accounts

A deposit is required from any new client before any work is carried out. It is the policy of JWP that any outstanding accounts for work carried out by JWP or its affiliates are required to be paid in full, no later than 28 days from the date of the invoice unless by prior arrangement with JWP.

Once a deposit is paid and work completed you are obliged to pay the balance of payment in full. We will contact clients via email and telephone to remind them of such payments if they are not received when due.

If accounts are not settled or JWP have not been contacted regarding the delay, access to the related website may be denied and web pages removed, we will then pass such cases to the Small Claims Court to pursue payment, non payment can result in County Court Judgments (CCJ's) being added to the clients’ credit rating.

Following consistent non payment of an invoice, our Solicitors will contact the client in question, with a view to taking the matter further and if need be to seek payment through legal procedures, and if necessary court summons.

21. Complaints Procedure

Informal procedure


Anyone who experiences a problem with a product or service provided by JWP should raise the matter directly using our online contact form or directly emailing support@jwpcomputerservices.com, giving sufficient information to locate the material (such as an URL) and clearly outlining the grounds for complaint.

JWP will approach the individual responsible for the item or material in question with a view to resolving the matter to the satisfaction of the complainant.

Formal complaints procedure

The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too serious to be dealt with informally, or where a satisfactory conclusion has not been reached after following the informal procedure.

A formal complaint should be made in writing to JWP, who will acknowledge receipt and ensure that the matter is looked into as soon as possible.

An initial response to any complaint can be expected within seven days of its receipt; a full and considered response to the complaint should be completed within 30 days and any subsequent remedy implemented with the minimum of delay.
